Contest entries must include a completed entry form. The photo contest runs from May 1st, 2010 through to September 6th, 2010. Entries must be received by the contest closing date of September 6th, 2010. All photographs submitted must include the I Love Fairmont Hot Springs .com Bumpersticker to be considered for the Grand prizes. Neither the sponsors nor its agencies of this contest are responsible for entries that are lost, late, delayed, misdirected, unintelligible, illegible, incomplete, returned, or undeliverable. This contest and voting privilege is only open to residents of Western Canada (BC, AB, SK).

There is only two photo’s allowed per month per entrant, to a maximum of 4. Compositional changes to digital files are not acceptable and will be disqualified; tonal or colorcast corrections are acceptable. There is a limit of one random prize and one grand prize per person or household. By participating, contestants vouch that they are the author and sole copyright holder of the submitted photograph, that they have obtained permission from everyone appearing in the photograph and that the photo has never been entered into or have won another contest.

By signing the Photo Contest entry form, the contestant grants the sponsors the unrestricted and exclusive rights to use photograph(s) for any purpose. This includes, but is not limited to, publishing your photograph(s) in print or electronic form for promotional purposes without further compensation, and the right to use the photographers name as a credit along with the photograph. The photographer must own all rights to any photographs entered in this contest. It is the responsibility of the contestant to ensure that publication of the photographs raises no legal claims.

Voting Eligibility
Voting for photographs must be completed with only valid email addresses, arriving from IP addresses in Western Canada, and validated by the owner in order to be accepted as a vote. Any automated voting submissions or the use of bots, will be rejected. The number of votes from any single IP address is 5 in a day. Email with only numbers or less than 2 characters are not considered valid and will be removed from the contest. Votes considered invalid will be removed from the competition and may lead to the disqualification of a contestant.

Determination of winner
The public will judge the photographs online at www.ilovefairmonthotsprings.com. The winning photograph will be selected by determining which has the most number of votes. Individuals are able to vote for their winning photograph only once per day. A list of the Contest Winners will be posted at I Love Fairmont Hot Springs .com. Entrants acknowledge that this is a Marble Ridge Developments Contest. By entering the Contest, entrants acknowledge that they have read, understood and agreed to be bound by the Rules.

Notification of winner
The first selected contestant will be contacted via an e-mail sent to the address provided by the entrant. The contestant must contact the Contest Holder within 48 hours of receiving the e-mail to claim their prize and be declared a winner. If the first selected contestant fails to contact the Contest Holder within that timeframe, they will be automatically disqualified. Then, the second selected contestant will be contacted and must meet the same conditions to be declared a winner.

Fanatic Photo Contestants can also win Random Monthly Prizes. These prizes are awarded at random on the 20th of each month between May 1st and September 6th, 2010. Four Random Prizes will be awarded in total by the I Love Fairmont Hot Springs .com participating sponsors.

Eligibility
The contest is open to all Western Canadian residents (BC, AB, SK) who have reached the age of 18 at the time they entered this contest. All entries become the property of Marble Ridge Developments and will not be returned. If the identity of an online entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid online entry in the Contest will be the Contest server(s).

Privacy policy
Entering this contest requires the disclosure of certain personal contact information by the entrant. Marble Ridge Developments is committed to ensuring the safe management of this information and will take all precautions to make certain that its use is explicitly and, wherever possible, solely and securely used for the express intention of contacting the selected entrants.

Rights of use and limitation of liability
Contest winners must consent to the use, if necessary, of their name and photograph for contest-related advertising purposes with no compensation. The Contest winner may waive their right to receive a prize. All Contest prizes are non-transferable, non-exchangeable, and non-refundable, have no cash value and must be accepted by the winner as awarded. Marble Ridge Developments and the prize sponsors reserve the right to substitute a prize of equal or greater value in the event that the specified prize is unavailable due to circumstances beyond their control.

By entering the Contest, entrants release Marble Ridge Developments and their respective affiliates, sponsors, advertising and promotion agencies and the immediate family and household members of the above, and each of their respective affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any prize, including any travel, skiing or snowboarding related thereto (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light) and indemnify Marble Ridge Developments and their representatives described above from any claims, alleged claims, damages, charges costs, expenses or fees related thereto.

Marble Ridge Developments and their agents are not responsible for: (a) any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail entry to be received by Marble Ridge Developments on account of technical problems or traffic congestion on the Internet or any website, or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer, related to or resulting from playing or downloading materials in this promotion including the recording of game results; (b) any incomplete or inaccurate information, whether caused by the website users or by any equipment of programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of entries; or © the theft, destruction or unauthorized access to, or alteration of, entries or the website.

Marble Ridge Developments reserve the right, in their sole discretion, to cancel, modify or suspend the Contest should a virus or bug or other cause beyond the reasonable control of Marble Ridge Developments or their agents corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Marble Ridge Developments reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
